I have filed a lien. I expected to get paid when the owners of the building sold the building. I have not been paid. How do I get paid?
Absent a recorded lien extension, mechanics liens expire and are no longer enforceable if a lawsuit to foreclose the lien is not filed within 90 days of recording the lien. If you recorded your lien within the last 90 days, you still have time to file a lawsuit to foreclose the lien. To maximize the potential to be paid, file a lawsuit to foreclose the lien before it expires. If more than 90 days has passed your lien is no longer enforceable. You may be required by the owner to record a release of lien.
If your lien is expired, your best bet to get paid is going to be to file a breach of contract action against the previous owner or whoever your contract was with.
You need to timely file an action to foreclose on the lien.
The sale does not terminate your lien rights.
