Subcontractor filing lien on house when I paid contractor

North CarolinaMechanics Lien

I had a new roof and gutters put on my house. Bulldog Construction in NC was the contractor who I signed the contract for. Bulldog Construction then subcontracted the work and they got it done. Bulldog was then paid in full. Apparently Bulldog then failed to pay his subs and now they are showing up at my house saying they will put a mechanics lien on my house. Is this possible?

While it is possible they could file a lien, that lien would be invalid as the subcontractor only has the same rights as the contractor to lien your property. If the general contractor has been paid in full, the subcontractor does not have a legal right to lien your property. If the lien is filed, it would be invalid and the subcontractor may liable for your attorney’s fees and costs paid to remove the lien.
