I work for a GC & we have a Subcontractor Affidavit form; don't know where it came from, who created it or if it's a valid document we can use. We require the Subcontractor to provide a supplier list & traditional conditional/unconditional, progress/final waivers for both the Suppliers and Subcontractor. There are some cases where the supplier did not perform work for the month and refuse to sign $0 conditional waiver. This is where the affidavit comes in. It gives the Subcontractor the opportunity to bypass the supplier and sign the waiver themselves. There are also different versions of this form; (A) the supplier not been used for the month (B) the supplier needs to be taken off their list of suppliers because they have not & will not work on the project or (C) do not have any suppliers associated to this project. All of them state the following: project name, number, and address, Subcontractor name & type of work; we require that it be signed & notarized. It's also important to note, these affidavits are NOT included in the contract like our waivers are.
