Should I file a suit at this time?

No preliminary lien notice submitted. Mechanics lien filed but deadline to file suit missed. Extend credit in process of being filed. Should I just get an attorney now or wait until I find out if the extension was granted?

Get an attorney now. If your lien rights don't exist, you can still pursue a breach of contract.

If I were you, I would at least speak to an attorney and see what options you have left. You may have waived all of your lien rights, but you still should have the right to sue on the contract. An attorney can look at your current situation and let you know what your options are at this time.
