We are a subcontractor who has been off of a state job for several months now. We KNOW the GC has been paid retaiange by the owner, but they have still not released it to us and they are telling us they have not been paid. What is the next step?
Depending on how long you have been offisite, you could submit a claim on funds to the public owner. The owner's response should answer whether payment has been made. If you are correct, and all funds have been paid to the general, then you could pursue claims under the prompt pay act, a claim for breach of contract, and a surety bond claim.
Thank you so much! We have been off site for over two months now. We have already had contact with the owner and they said a very small portion of the retaiange to the GC has been held by the owner, but it has nothing to do with any of the subs. It is being held for maintenance by the GC per their contract with the owner.
