When it comes to rental equipment/material in the state of New York what dates would start our deadlines? Would it be the date the equipment/material is returned? Please advise.

Generally, New York mechanics lien deadlines are based on the last date when labor or materials were furnished to the project.  Typically, for equipment rental companies, the last furnishing date will be the last date when the equipment is used on the project site, in accordance with the lease agreement. Though, if the equipment just lays at the site well after the rental agreement has run, failing to pick up that equipment likely would not extend the deadline to lien.
