Removing a mechanics lien from a NYC property

New York
Anonymous Contractor

Hello - I am a general contractor in NJ who also works in NYC. We had a subcontractor place a lien against one of our properties for monies they are not entitled to. We bonded it off, but I am not sure of the next steps in the process to have the lien dismissed. What are the next steps I should take? Thank you, Brian Sharrock

You can always serve a demand for a verified statement of lien, which will compel the lienor to set forth the details of how the lien is computed. If they fail to respond, then the court can order the lien discharged. You can also demand that they commence the foreclosure action. If they fail to that, then the court can similarly order the lien discharged.
