Received NOI for lien

Arizona

Long story short version. I had water damage , first on-site came and gave me a initial estimate for repairs. Nov 2021. Came out Dec 2021. A contractor came and gave me a run down of what was going to be done. Lots of painting , drywall etc. The first time anyone arrived to do any work was after multiple cancellations by them. A man that was picked up at Home Depot was brought to my home had no tools or anything. He was told to start putting insulation back into my walls and start painting from living room to front door of my home. My house was literally destroyed by paint in a matter of hours. I asked this gentleman to leave and then contact the contractor stating I did not want anyone back in my home. last contact with them was Jan 6 2021. I am now receiving a bill and NOI to file a lien for 7900$. First bill was Dec of 2022 I emailed the manager and we had some back and forth. Now it’s April 2023, I’ve received his notice. How is this even possible that I am being scared to think I would have to pay 7900$ for what ??? I never signed anything , no job was ever completed. I still have the drywall that was purchased in my garage for two years. I’m so confused at what this company is actually trying to get away with. Please help.

I am sorry about the issues. If the only time they came out to do work was in December 2021, the NOI is baseless and any lien would be spurious. An NOI is to be done within 20 days of the work. If they came out December 2021 and serving an NOI now, that lien does not comply with the law.

In short, I would not worry about the NOI. If a lien is actually filed, then hire an attorney to make a demand and it would likely be released. If they refuse to release, you can sue and demand your attorney fees and costs to get it released. If they proceed to sue, then also hire an attorney.

Our office offers free phone consultations as do other firms. Reach out to an attorney for questions.
