Real or bs?

New YorkMechanics Lien

My dad got into an argument with a contractor that orchard a peeved of land across the street from his house. The contractor was doing constructing without permits and leaving trash and debris all over the place, creating an eyesore, safety issues, parking difficulty etc. My dad reported the construction without permits and the police and other authorities shut the site down. The next day my dad got a one page typed notice of mechanics lien from this contractor claiming tortuous interference causing damages of 300k. I doubt it's real, it sounds like BS to me and paper terrorism (found that term online). I would think this prices to file a mechanics lien on my dad's house is more difficult than some stranger putting a note in his mailbox over being pissed my dad had him shut down for building without permits.

This contractor has not used the lien law properly. Generally, liens may not not be removed outside of a foreclosure process. You may want to retain counsel to consider whether this is such a case. you have other options including a willful exaggeration claim in a foreclosure action. you should consult counsel. there are too many unknown facts that may impact your decisions.

Thank you. I'm not sure if this guy even filed anything or is just bluffing to harass my dad. Is there a way I can see if there is a lien filed on the property?

you may check the land records and lien docket in the county clerk's office.
