Property Owner sold mid job, do I still have lien rights?

Louisiana

We supplied roofing materials to an LA subcontractor. The property owner sold before our work was done, do we still have lien rights?

The answer will be found in La. R.S. 9:4811. The simple answer is they may potentially be entitled to file a lien against the property even with a new homeowner.

Essentially, the issue of whether a subcontractor is entitled to file a statement of claim or privilege revolvesaround whether or not a notice of contract was filed pursuant to 4811. If the project would be governed by the Private Works Act and the Notice of Contract was timely filed, then the subcontractor should be able to file a lien against the property of the non-party / new owner as they would have been on notice of such a right by the subcontractor. So the answer is potentially you could depending on the facts and circumstances of the situation.
