prevailing wage question

CaliforniaPrevailing Wages

We were awarded a small (under 25,000) job that is prevailing wage. We are a small company and we have no employees. If we are doing all of the work ourselves on this job will we still need to pay ourselves a certified payroll check with prevailing wage rates? Also, we are registered with the DIR.

Any time a job is a prevailing wage job, then certified payroll will be required and prevailing wages must be paid for covered work. Section 2.3 of the CA Labor Commissioner's Public Works Manual makes it clear that prevailing wage laws will apply, "regardless of whether the individual holds a particular status such as partner, owner, owner-operator, independent contractor or sole proprietor, or holds a particular title with the employer such as president, vicepresident, superintendent or foreman." So, if the parties who are working on the job are performing work that generally requires prevailing wages, then those prevailing wages must be paid - and certified payrolls will still be required. Admittedly, though - California's prevailing wage requirements aren't quite my area of expertise. So, for further instruction or information, it'd be wise to consult a California construction attorney who's familiar with the state's prevailing wage regulations. Additionally, services like eBacon or Contractors Prevailing Wage could help with prevailing wage compliance.
