Hello, I am a dump truck driver in the Sacramento area. Last week I worked on several different jobs, and by Thursday had worked 43 hours. On Friday I worked on a prevailing wage job for 8.5 hours. Our employee handbook states we are paid overtime after 8 hours per day, or 40 hours per week. My question is if that Friday, that I worked on the prevailing wage job, should have been all overtime at time and a half? Do prevailing wage jobs pay overtime like regular pay jobs? Thank you. Prevailing wage jobs in California do require overtime pay, but the requirements can be confusing. Overtime pay is required for work on weekends or holidays regardless of the number of hours worked, and must be paid overtime for work in excess of 40 hours per week or 8 hours per day. Additionally, the calculation of overtime can change if the employee works over 12 hours in one day or more than 8 hours on the 7th day of a period. Additionally, the calculations are confusing when employees work on multiple projects. For the purposes of prevailing wage overtime rules, overtime must be calculated based on all work for the day, no matter whether some of the work was on a non-prevailing wage job site. For example, if an employee spends 4 hours on a private job and then 5 hours on a public prevailing wage job, that employee must be paid overtime according to the prevailing wage overtime wage determination.
