Roofing Contractor placed a lien against our property while waiting for the insurance check to arrive. An insurance check that was delayed because of the numerous times that the roofing contractor kept submitting more and more claims trying to squeeze everything they could out my insurance company. For four months the roofer went back an forth with the insurance company for more and more and more. Finally on August 9, 2021 a settlement was reached between the Insurance company and the roofing contractor. Then we had to wait for the check to arrive in the mail....10 days later, Saturday, August 19th, 2021. However, we left on vacation on Friday, August 18, and received our collected mail upon our return home, Sunday, August 22, 2021. Today, August 23, we received an email from our roofing contractor that they had placed a lien on our property. Meanwhile the check from the insurance company still has to go to our mortgage holder for endorsement and return to us to deposit and write a check directly to roofer. How is this even possible. There roofer delayed his own payment by his need for a bigger payoff. Initially, we were quoted a roof replacement cost of just over $12K cash, no insurance. The total payouts between the insurance company and my out-of-pocket deductible is a grand total of +$36K - 3 times the original offer. House built in 1957, footprint about 1500 Sq.Ft. which includes the two car garage. $36K can't be right for a home in one of the less expensive states in America to live in. Was this lien that was filed premature? Was it a frivolous waste of the courts time? How will this effect my credit rating? Do I have recourse to contest their filing?
