IllinoisLien Waivers

I'm in Illinois and My general contractor told me to order a particular piece of equipment and now does not want to pay me for it. Hes willing to pay for everything else but that. I want to sue him but he is requiring a final lien wavier before I can get my check. I want to sign a partial for what I have done so that I can still sue him.

A "Final Waiver" must include the cost of all items ordered in connection with your work, and those ordered at the GC's request. If the GC wants to hold onto final payment based on you filiing a false waiver, then you may seek damages for fraud and breach of fiduciary duty. That said, whether this is worth fighting depends on the amount at issue. 

That is your call. Just know that you are on the right side of this issue.
