I work for a general contractor who is providing both preconstruction and construction services to the Owner in Utah. I know the Preliminary Notice filing will cover the construction work but do not see an option for the Notice of Retention filing required for preconstruction work on the SCR database. Is this the same as the Notice of Preconstruction Services?
Utah law requires that in order to assert a lien for preconstruction services, a person must file "a timely notice of preconstruction service." https://le.utah.gov/xcode/Title38/Chapter1A/38-1a-S401.html. You should discuss your situation with a construction attorney.
