How can a Notice of Nonresponsibility be countered by the contractor?

First, the contractor needs to make sure that the owner followed through with all of the requirements in order to make the Notice of Non-Responsibility valid. Those items include either requiring the tenant to post a bond for the work or include a construction control account as part of the payment process. If one of these options were not done, then the contractor has a right to proceed with a lien against the property. I would suggest you speak with a construction attorney on your specific issue in order to get the best legal advise.
