Notice of commencement question

Florida

We are replacing two sliding doors in our home. The window company filed a NOC in March for the job. We are paying cash for the doors. We have no idea when the doors will arrive and be installed at this time. We currently are applying for a home equity loan to renovate a bathroom. Our credit union will not process the loan until the NOC is removed. Is there any way around this since we never borrowed money for the doors?

The problem is the "window company" may have subcontracted the installation to another company who could theoretically file a lien. So even though you paid cash, the sub won't be paid until the windows are actually installed, and that could be months from now. But you need to record a notice of termination and you will need an affidavit from the window company for that purpose. I would ask your lender if their title company could prepare the paperwork and you can take it to the window company to get their signature on the affidavit. Hopefully, they will work with you.
