If the owner fills out the notice of commencement. Do they have to file it or can the contractor have to file it?

It is the owner's obligation, but from a practical standpoint, contractors file them to make sure it gets done. Typically, building departments require it to be on file before issuing permits.

It is the owner’s obligation to have it recorded, but the contractor often does it for them.
