Each state varies on how to handle what we refer to as "no-lien clauses." In Ohio specifically, there is no explicit law that prohibits the waiver of lien rights in construction contracts. In fact, no-lien clauses have been upheld by Ohio courts against the contractor who signed the agreement. Contractors who encounter such clauses within their contract would be wise to attempt to negotiate the clause out of their contract. For more information: Ohio Lien Waivers Overview & FAQs
