Need Help Pls

TexasCollections

I am a subcontractor for roofing. I was hired by a big company and due to price fluctuations we had over the last 2 years, material shortages and delays I had my msterials delayed and didn’t have money to purchase my materials so I asked for help which they did help me pay for those. But it delayed the project a few weeks or so. When we finally get the roof installed the stucco on outside wasn’t done so no way of fully sealing in the building so it leaked. Of course the leaks are the roofers fault right? Sure enough we went out multiple times had my manufacture inspector go out and we couldn’t find the leak until they finally installed stucco. Long story short builder is holding my money for 2 separate jobs not related to this project plus $25000 from this project and claiming there was 25000 in repairs that were done due to leaks that were my fault also not acknowledging several change orders and and bad mouthing me and trying to paint a picture saying I never answered any messages or phone calls which is not true. I don’t know what to do they owe over 35k and i need help pls. Oh I filed a lien on the project they owe me 25k but they bonded around it.

The fact that the prime contractor filed a lien release bond around your lien means that it is no longer encumbering the property at issue. As such, there is less incentive for the prime contractor to act and/or respond to your lien claim. Accordingly, it is incumbent on you to move forward in attempting to collect the money you are owed. The most common first step is to retain an attorney to ensure that you are meeting all of your potential deadlines and drafting a demand letter to the prime contractor regarding the merits of your claim and requesting payment. Ultimately, going over the merits of your claim with an attorney and analyzing whether you have met all notice and/or filing requirements will be helpful in determining whether you will ultimately file a claim on the bond if the prime contractor does not respond to the demand letter to your satisfaction. I hope this helps.
