Need help on next step from mechanics lien in CA

California

Hired as sub-contractor for installation of equipment by contractor. Following installation, we were informed that owner ran into financial hardship and asked if we would delay our billing which we denied. Filed Lien on 3/2022. As of 6/2022 no word or payment from owner or contractor. Is the best next step the extension of the mechanics lien or to file suit? If file suit, what is involved in this?

If you had filed a 20 day prelim, and you are still within the 90 days window in which to file suit, then you are probably in good shape and should file suit immediately to protect your rights. If you did not do a prelim and gave notice to owner & lender, then your rights against the owner is pretty limited. However, it doesn't mean that your claim is completely dead either. There are other strategies you can still use, including filing suit, in order to force owner & GC to cut a deal with you. Consult any of the qualified construction attorneys working with Levelset to get it started immediately as your timeline is very close to ending.
