Need help filing a mechanic's lien

We did a job for a client, and they were slow paying. In our contract that they signed, it states that the balance will be due upon delivery of product. In this case, their kitchen we built. At the time of delivery, their full balance owed us was $17,952.00 . Additional items we did were later added to another invoice and have not payed. My question is, what are the legal steps I need to do to file a mechanics lien in the state of Texas? I just sent an intent to file with levelset, but now need to file a mechanics lien and then file asap with travis county clerk. It needs to be notorized and signed? Can you please help me figure out how to do a mechanics lien so i can file asap. Thank you

Yes – you need to consult someone who handles this work. An improperly noticed lien/wrongly recorded notice is not helpful.

There are plenty of resources you can find online, perhaps through Levelset, explaining the process if you will be handling yourself.

Hello!

It sounds to me like your company is the one who signed the contract directly with the property owner. In this case, you didn't even have to send the pre-lien notice.

Your next step is to file what is called an Affidavit Claiming Lien with the Travis County Clerk or the County Clerk of whichever County the property is located in. There are some things that absolutely have to be included within the Affidavit or your risk it being declared Invalid. The things required to be in the Affidavit can be found in Chapter 53 of the Texas Property Code. Levelset can also help you with the Affidavit Claiming Lien or you can contact my office.
