I failed to file a preliminary notice and my sub did and they filed a stop notice. Does that mean I will have to pay them out even though I have not been paid?
Are you a GC? In that case you typically don't have to file a prelim. You will have to pay them out even if you did not get paid. In this situation you should use the sub's lien to put pressure on the owner to pay you. Feel fee to call or email if you want to talk about specifics.
