Hello, I am contractor in California attempting to collect money on projects that are past the mechanics lien dates. Is there any legal way to collect even if I am past the date? Can you please advise on what are my options. Thank you
Even if the contractor does not have lien rights, it can still enforce legal remedies for non-payment under breach of contract and quantum meruit.
The time to lien a job can be pretty long depending on the details. You may have 90 days from completion of the project or 60 days from when the owner records a notice of completion.
Assuming that time has passed, you can sue whoever you had your contract with for breach of contract. On a typical written contracts you have four years from breach to sue.
