You are probably out of luck if you missed the deadline. The lien foreclosure suit must be filed within six months after the lien is recorded. There is not an exception under the statute for being out sick on the date of the deadline. The only way health can toll a statute of limitations is if you are of "unsound mind," which typically means insanity or incompetency. You can still sue in small claims court for the $3,000 under a theory of breach of contract or unjust enrichment. It's just that the debt is not secured by a lien on the property.
