Mechanics Lien after a Notice of Intent to File Lien

Maryland

I'm a material supplier and I had Levelset send the Notice of Intent to File a Lien and it states that if the invoice is not paid in 10 days a lien will be filed. However the next step in Levelset is the ' File Petition to Establish Construction Lien' which isn't for 5 more weeks. I'm confused and need clarification of the steps.

Thedeadlne for submitting a Notice of Intent to Lien in Maryland is 120 days from last providing labor or materials (you can submit that Notice at any time during the 120 period). The Notice is not a lien. If the Notice of Intent to Lien is timely and properly submitted, you can then petition the court to establish a mechanic's lien so long as your petition is filed within 180 days from last providing labor or materials (again, you can file at any time during teh 180 day period so long as your Notice of Intent was submitted prior to filing your petition to establish a lien). What you may be seeing is that you had five months left to file a petition to establish a lien, not that you are required to wait five more months in order to file that petition.

Without reviewing the document itself, it would be difficult to give you an idea of how best to proceed forward. It sounds like you may still be in your window to establish a lien. Please reach out directly to myself or another attorney to go over your Notice. Feel free to reach out to me to discuss specifics: https://www.savlawfirm.com/contact
