You have multiple options at this point. You can retain counsel to send a letter on a law firm letterhead which may let them know you are serious about potentially escalating the dispute. If this is a residential project, then you have 60 days from your last date of work to begin the lien process, and if it is a commercial project, then you have 90 days to file your lien. Following that, you have 1 year to file a lawsuit to foreclose on the lien. But you can also file a breach of contract lawsuit regardless of whether you file a lien. You should contact an attorney to discuss details and determine if the potential costs of taking any form of legal action are worth the it when compared to the outstanding balance owed.
