Lien on property from a mechanics

Colorado

Company refused to wait for my insurance company to send me a check. Found out 3 days ago that the check was sent to the company. and now we can pay the remainder of the balance of September 30, 2021. Getting ready to sell my home next week and the Title company informed me that the company has a lien on my home. I looked and found I was given an NOI on the 20th of September by email (it went to my junk mail.) I contacted the company yesterday to give them a check for the remainder of the balance and they refused and said, "the lien has already been processed with the title company". The title company has said we can pay the company and they can write a letter of Release of Lien. Can this company put a lien without going through the courts? What can we do? We want to pay but they are refusing. Please advise our next step. Thank you for your time.

Good afternoon Martha and thank you for reaching out. I am sorry you find yourself in this situation. Yes, a lien can be filed on your property without going through the courts, but that doesn't always mean it is a valid lien. When you called the company to pay, did they say they wouldn't accept payment because there are additional costs incurred? Please provide a few more details and I will do my best to get you the information. In the meantime, here is a great article around your situation. Colorado Lien Release
