TexasBond ClaimsMechanics LienPayment Bond

Working on a Tex-dot project and have two invoices that have gone unpaid. 1st invoice is 128,936.10 and the second one is for 355,000.00. Do i file the lien at one time for the whole amount or do i have to file two different liens?

Hello,

You don't file a lien. Those are government projects so you need to send notices of nonpayment to everybody up the chain from you AND ESPECIALLY the surety (insurance company) that wrote the bond the general contractor was required to get when he started the project. That should start to get things moving. In the event no payment is forthcoming, let's get to suing!

You cannot lien a TxDot project. You need to file a claim against the payment bond. The time frames are stricter than for mechanic’s liens. Look carefully at the statutes and your dates.
