Hello Levelset Legal, I am reaching out requesting assistance on determine the best last day worked to use as we prepare to file a mechanics lien for nonpayment. The two dates we have are:

 October 25, 2021 December 8, 2021 The October 25, 2021 date is last day worked as part of the original contract, with a significant amount of work being done. The December 8, 2021 work was part of the original contract work that was not completed in October; it was not warranty or punch list item work. It was part of the original contract. Given this information on the difference of workload between both of these dates, what is the recommendation for which date should be used as last day worked on the lien? So long as the December work was not trivial (of little worth or importance) that is the date to use.

One final question: can we add in the legal fees and costs for filing a lien in the total amount of the lien claim?

No. Only labor, services and materials provided to improve the property may be included in the lien. But payment of attorney's fees and costs will be added to the lien if a court awards them in a lawsuit to foreclose it.
