is it worth it to file a small claims court

Illinois

I was a subcontractor on a project and never paid by the contractor. They have since been fired from the job and i think my only means to recover my unpaid funds is to file a lawsuit, the outstanding balance is 5k. Im curious if it's worth it to file suit.

You ask if it is worth filing a Small Claims suit for $5,000 against a GC. The answer depends on whether your entity is incorporated, and the terms of your contract with the General. If your business is incorporated, you will need an Attorney to file suit. Business entities cannot represent themselves, and you cannot represent your incorporated entity. If, however, you are doing business as a sole proprietor, you can sue yourself. You will find that most counties provide user-friendly resources to permit you to file your case. You may engage a lawyer to help you interpret those resources.

Unless you want a piece of paper you can throw in the trash sadly, no. I help contractors get paid and noticed you were having issues If you need help, feel free to reach out.
