Is it too late to file mechanics lien and what other options do we have which will force client to pay?

New York

We are a floor installation/refinishing company. On March 8th we started job. We had to re-do her floors twice because color was off. We finished the project on 3/13. Client was finally happy with floors - we even buffed/coated her stairs for free for her inconvenience. We sent client invoice via email from Quickbooks multiple times. We also sent gmails and text messages without a response (approx 5 emails). Also tried to call once. After a few attempts and no response I sent email advising I would have to file a mechanics lien if we did not receive payment. We received a response and was told payment would be sent. This happened on two separate occasions. We have yet to receive payment and want to know if we are past the timeframe in which we can file a lien against their property? What other recourse do we have?

All mechanics liens in New York must be filed within 8 months of last furnishing unless the lien is against a single-family dwelling. If you furnished labor or materials to a “single-family dwelling,” your mechanics lien must be filed within just 4 months of last furnishing.

Feel free to contact me if you'd like to move forward.
