Is it the law in Georgia a joint check is required if supplier of the subcontractor sends a NTC to General Contractor?

Anonymous Contractor

The General Contractor is saying that since they received a NTC from one of our supplier's by law they have to issue a joint check to us and that supplier for the amount the supplier has listed on the interim waiver. Is this correct for Georgia projects?

No, that is not true. Georgia law never requires a joint check to be issued. Certainly, the fact that a NTC was provided should not, by itself, justify a joint check arrangement. Joint checks can be issued by agreement of all parties, or if your subcontract provides for it. I would be happy to review your subcontract and give you my thoughts, but I doubt that it justifies the GC's threatened action.

There is no law in Georgia that joint checks must be issued due to the filing of a Notice to Contractor.

No it is not required by Georgia law. However, often subcontracts permit the issuance of joint checks. Becuase they have received a NTC, it is in the GC's best interest to ensure that the supplier is paid.
