Is it best for an architect to file a lien against someone for a project that was not completed?

North CarolinaBack Charges

Small architectural firm in NC dealing with unpaid invoices totaling for $47,800.00. Invoices date back to last summer. Client is sheltering in SC and not returning phone calls. The client has sent multiple emails with promises and "plans" but no money. The delay was "I need this for the bank to approve financing" and we complied. Now that Covid has hit, the project is dead. We are exploring options to collect this debt.

When did you last perform services for the Owner for this project? Under North Carolina law (not sure if the project is in NC or SC), you must file the lien within 120 days of last performing work for the Project. South Carolina law requires the lien to be filed within 90 days. Is this a viable option? if so it could protect you until you know whether the project will proceed.

You should also consider filing a lawsuit to collect your fees. Times are tough but the squeaky wheel does get the most grease, and the fastest.
