FloridaPrompt PaymentRetainage

We are a contractor of DTPW for a construction project and we're trying to determine if our project is covered by the Prompt Payment Act or if it's excluded.

DTPW is a part of the Miami-Dade County Government. So it is not covered by the same prompt payment act as FDOT. Rather, it is covered by the Local Government Prompt Payment Act. Under that Act, a local governmental entity like DTPW has either 25 days to pay (if an agent must approve the payment application - e.g., the project engineer) or 20 days, if no agent must approve the application. If the application for payment does not meet contract requirements, DTPW would have to reject the application in writing within 20 days and provide the deficiency and the action required to correct the deficiency.
