Is a subcontractor responsible for billing on behalf of the contractor?

The contractor we work for insists that we the subcontractor add a 10% fee and administration fee for them on our invoicing and scope of work. I feel like this is illegal but I am unsure.

Based on your question, I can't imagine that you would have to do that.  This looks like the contractor wants to pad his billing.  Generally, a sub would bill the GC with its own markup as part of its pricing and then the GC would add its fee.  I can't opine further given the absence of detail, etc.
