Under New York mechanics lien law, there is no specific requirement to send a preliminary notice prior to filing your claim. The deadline to file a NY mechanics lien on a single-family home is within 4 months of the last date of furnishing labor or materials to the project. There is an optional notice that you can send beforehand, that is typically effective to inducing payment. This is referred to as a Notice of Intent to Lien. Consider it a final warning shot declaring you haven't been paid, and the if payment isn't forthcoming within x amount of days, you are willing and able to file the claim against the property.  You should give the owner a few days to try and resolve the payment dispute before you file your lien.
