In Michigan, I am 21 days from first delivering materials, should I still send notice of furnishing?

MichiganPreliminary Notice
Anonymous Subcontractor

Our crew recently did a project for a General Contractor and I totally dropped the ball on sending the notice of furnishing. I ordered it today, but we are 21 days outstanding, does it make sense to still send it and can I perfect my lien rights if necessary? For reference we are still currently working on the project.

Typically, to secure full rights under a Michigan mechanics lien, a Notice of Furnishing must be sent within the first 20 days of first furnishing labor or materials to the project. However, sending this notice late will not result in the loss of lien rights. Rather, if a mechanics lien is eventually filed, it will only cover labor and materials provided after the notice has been sent.
