In Michigan, can I require a Subcontractor to sign an in-house lien waiver IN ADDITION to the statutory lien waiver form
We are based in VA, and our Subcontracts are governed by the state of VA. Additionally, the Owner that we contract with has their own required forms. Can we ask Subcontractors to sign forms IN ADDITION to the statutory form in order to get paid?
In Michigan, the Michigan Construction Lien Act mostly mirrors the requirements of the "uniform construction lien act". You can enforce almost any requirement you want in order for the sub to get paid, but it might not be necessary if the statutory forms are being utilized.
