In Illinois what parties must be included in an action to foreclose a mechanic's lien?

IllinoisLien Foreclosure

A tenant had work performed on the property but recently went bankrupt. If the tenant must be named in the lawsuit, it will be barred by the bankruptcy stay. But is the tenant a required party to the lien foreclosure action? Or can just the property be owner be named?

The answer to the question is a lot more complicated than may appear, and not all of the potential client’s assumptions are correct. Most of the answers can be found in my book, Turner on Illinois Mechanics Liens pages 69-80 Second Edition (2019) published by the Illinois State Bar Association. For reasons of insurance coverage, I cannot answer any of these questions (and others that are relevant) unless I am retained to represent the client. You may give him my contact information.
