If you have a contract with patio at grade, can the builder charge you extra for a having to put in a retaining wall?

We are building a new house that we have added a custom patio to. The contract reads patio at grade level. The builder has now told us 1 year later that they need to add a retaining wall and it is going to cost an additional $11,000. Are they legally allowed to do this?
