If my builder does not follow the contract do I have any rights to force him to?

I am building a new house and my contract calls out a hot roof, two zone heat and the placement of the heating system in the basement. I am not getting a Hot Roof, only getting single zone heat and the heating system was placed into the attic. I tried to work it out with the contractor and he would rather refund our money and sell the house to another party as he believes he can get more for the house. We do not wish to walk away. What are our options?

it depends on the contract and you should retain counsel. Terminating the builder, having someone finsih the house as per plans and specs and the presenting the builder with the invoice is one option. my question is how many other short cuts did he take? you need guidance from a architect and a lawyer. good luck

So the funny thing is I am a NYSPE so the builder has met his match. Finding another builder is not an option as this was a new home purchase and the builder owns the land. Will be interesting for sure.
