If I sue what can I expect to get? Can I get my money back & what penalties will he get from the TDLR & the prosecutor?

HIred a supposed electrician in Texas to wire up my swim spa. He said he was a master electrician; he didn't even have a license. He used the wrong size wire, hooked the spa directly to the pole box without a GFI switch or disconnect box and buried the wire in exterior piping not specified to underground. We had to hire another electrical company to totally redo all the work. He won't give us our money back and he could have actually electrocuted someone. What can I expect the conseuqences or penalties incurred by the TDLR and the prosecutor? Could I get my money back?

I trust that you filed a complaint with the TDLR arising from the unlicensed electrical work. A link to the enforcement penalties and sanctions is:

Restitution is quite another issue, and may require that you file suit. If the matter is less than $20,000, you can consider filing suit in small claims court. To help establish a small claims court suit (or suit in any court), you should consider preparing a letter to mail by certified mail to set out the facts, and to point out the deficiencies in the contractor's work. Support your letter with photographs and repair estimates to remedy deficiencies. Also, request a refund of the money you paid. If need be, consider using the letter to support your suit.
