If I foreclosure on a property in NEW JERSEY for a mechanic lien I filed last December, can I get attorney and other related costs reimbursed to me ?
Thank you ?
As you may know, a New Jersey mechanics lien, itself, may not include costs, interest, attorney fees, etc. In a situation where a mechanics lien claimant must enforce their lien claim and successfully forces payment, a property owner may well be forced to pay for the fees of the prevailing claimant.
However, there's nothing in the New Jersey mechanics lien statute that seems to mandate that attorney fees or other costs be paid. In the end, it'd probably be up to the judge to make that decision.
