I'm sorry to hear you've gone unpaid. Are you referring to the Texas 2nd month notice? For those without a direct contract with the property owner or the GC, a 2nd month notice is required in order to preserve the right to lien - and the notice acts to trap funds on the project. The notice must be sent to both the owner and the GC, and it must be sent no later than the 15th day of the second month following each month in which the lien claimant furnished labor or materials for which he is still unpaid. You can download a free copy of that form here. Not also that a 3rd month notice is also required for subcontractors - and it must also be sent to the property owner and the GC. It's sent no later than the 15th day of the third month following each month in which the lien claimant furnished labor or materials for which he is still unpaid. You can download a free copy of that notice here. Finally, note that when the 15th is a Saturday, Sunday, or holiday, the notice should be mailed prior to the 15th.
