I put a bid in on a barn that burnt down and it was accepted by the insurance company and the property owner of the property owner had me sign a contractors waiver of lien conditional upon payment of and I went and did some work and then never got paid so you stop doing the work what can I do

I am sorry to hear about the trouble you have experienced. Lien waivers are like a receipt for project payments. However, a lien waiver is actually a legal document that has some very serious consequences. As the name implies, when someone executes a lien waiver (signed the waiver document), they are giving up their right to file a mechanics lien. In other words you are giving up your right to get paid. However, you signed a conditional lien waiver, which here at Levelset we always recommend! A conditional lien waiver that is signed is only effective upon the occurrence of something else. The “something else” is almost always the actual receipt of payment. In other words, getting paid is the condition — the signor’s lien rights are waived if and only if they actually get paid. A conditional lien waiver is effective when the "condition" -- receiving payment -- is satisfied. Luckily, you signed a conditional lien waiver which still protects your right to file a mechanics lien to ensure you get paid!
