I received a notice of contest of lien recorded in Palm Beach County

Lien Foreclosure

This notice is for 60 days and notes that I may file suit to enforce my lien. Does this mean that I need to file a lawsuit within 60 now and the lien is eliminated after 60 days? Do I need to hire a construction lawyer for this?

Yes, a property owner can essentially force your hand in Florida by filing and sending a Notice of Contest of Lien. This notice will significantly shorten the deadline to enforce your lien claim. What is typically one year from when the FL mechanics lien is recorded, will be reduced to just 60 days after the notice is received. If an enforcement action isn't initiated within those sixty days, the lien will expire and not longer be enforceable. An enforcement action is a full lawsuit, so I would definitely recommend hiring a local construction attorney to help guide you through the process. We do have a few Florida construction attorneys in our Expert Center Community that you can reach out to personally. Good luck! Here are a few resources you may find helpful.
