I invoiced and now they are refusing to pay, the invoice is $3300. Is there any thing I can do to recover this money

Colorado

I worked on this job with my helper for 4 days and then was released by the owner. She wanted a person who only did tile work to finish this job. I had done the work per her requests. Now the new tile person has said that my work was not done correctly. She wants to deduct costs to correct based o this new person.

There are a few things to unpack here that aren't mentioned, like the existence of a contract and its terms as well as more detail on the claimed defective work, that affect the answer to your question. Feel free to call my office to discuss. 7205007855.

Good morning,

You can first follow the lien process to the letter related to filing a lien. Sometimes that helps getting paid. Given that the owner has said your work was defective I suspect that the lien filing, if you proceed that route, will not result in payment. If that lien filing does not result in payment you are likely best off by proceeding with small claims. In that action you can all but guarantee that they will counterclaim for defective performance.

The Colorado judicial branch website has excellent instructions, overviews, links and forms. You should also consider going to the small claims clinic. The rules, the handbook, instructions, forms and other resources are all available here https://www.courts.state.co.us/Self_Help/smallclaims/

Please note that the foregoing is not a representation that the information is all that one needs for your matter or a warranty on their accuracy.

If you cannot afford a full representation, you should contact an attorney and consider having a limited representation. In this representation, the attorney provides specified services and they do not enter as the attorney of record in the case. This is normally less expensive and requires a smaller retainer. Our office and others offer limited representation. This is a brief overview https://bit.ly/3xY5VJS.

I hope this helped answer your question and reach out to attorneys for a consultation right away.
