I have sent a preliminary notice to owner, after how long I can file a mechanic lien?

We finished this roofing job on 8/23/2021 and sent invoice on the same day, I have sent some due reminders but have not received a reply. I have sent the preliminary notice to owner on 9/8/2021.

This is not the best way to handle a preliminary notice. A preliminary notice should be send within 20 days from the commencement of work, materials or services being provided at the website. Your question does not state how long you worked on the roofing project, but if it was commenced prior to August 19, 2021, then you should be ok to send out a lien for the entire amount that you are owed. If you commenced work prior to August 19, then you should try to come up with a method of quantifying the work that did take place within twenty days from the date of the notice. A mechanic's lien can be recorded as soon as all of the work contemplated under the contract has been completed. I suggest you consult with an attorney to advise you specifically concerning your situation.

You can file a mechanic’s lien at any time after sending the preliminary notice as long as the money is due. You don’t have to wait. I’m happy to answer any questions you have about this.
