Filing a lien on a residential property in New Jersey is a complicated process. New Jersey's legislature acknowledged the impact a lien can have on a property, and the significance of a person's residence financially, and set forth some additional protections for residential property owners through creating additional steps in order to file a valid lien. On residential projects in New Jersey, filing a lien is a multi-step process. One of these steps is filing an arbitration demand with the American Arbitration Association, and getting the award from the arbitrator of a right to file the lien.
